Please read these Terms of Service (“Terms”) carefully before using the BIMStack platform or website operated by BIMStack Ltd (“BIMStack”, “we”, “us”, or “our”). By accessing or using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing BIMStack — including our website, early access programme, and any associated services — you confirm that you are at least 18 years old, that you have read and understood these Terms, and that you agree to be bound by them. If you are using BIMStack on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

BIMStack is an early-stage platform designed to enable collaboration and process automation across construction project teams — including project managers, contractors, subcontractors, and vendors. The platform is under active development. Features, workflows, and pricing are subject to change. We make no representation that the service will be uninterrupted, error-free, or suitable for any particular purpose at this stage.

3. Early Access Programme

Participation in our early access programme is by invitation. As an early access participant, you may be asked to provide feedback and take part in research conversations. Early access may be provided free of charge during this period. We reserve the right to limit, modify, or discontinue early access at any time without notice.

4. Your Account

If you create an account with BIMStack, you are responsible for maintaining the security of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@bimstack.io if you suspect any unauthorised use. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to use BIMStack to upload or share unlawful, harmful, or fraudulent content; attempt to gain unauthorised access to our systems or other users' accounts; reverse-engineer, decompile, or reproduce any part of the platform without written permission; or use the service in any way that violates applicable laws or regulations.

6. Intellectual Property

All content, code, design, and branding on the BIMStack platform is the intellectual property of BIMStack Ltd unless otherwise stated. You retain ownership of any data or content you upload to the platform. By uploading content, you grant BIMStack a limited licence to store and display that content solely to provide the service to you.

7. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy, available at bimstack.io/privacy. By using the service, you consent to the collection and use of information as described in that policy.

8. Disclaimers

BIMStack is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the service will be available at any given time, that it will be free from errors or viruses, or that the results obtained from using it will be accurate or reliable. To the fullest extent permitted by law, BIMStack disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BIMStack Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the service. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us in the twelve months preceding the claim.

10. Changes to the Service and Terms

We reserve the right to modify or discontinue the service (or any part of it) at any time. We may also update these Terms from time to time. When we do, we will revise the “Last updated” date. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.

11. Termination

Either party may terminate use of the service at any time. We may suspend or terminate your access if we believe you have violated these Terms, or if required to do so by law. Upon termination, your right to use the service ceases immediately.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
